Terms of Service for Digital Products

Welcome to My Visionz LLC! These Terms of Service ("Terms") govern your use of our digital product(s) ("the Product") provided by My Visionz LLC. By accessing or using the Product, you agree to comply with and be bound by these Terms.

1. License to Use the Product

Upon purchase, My Visionz LLC grants you a limited, non-exclusive, non-transferable, personal license to use the Product for your own individual or internal business purposes. This license does not transfer ownership of the Product to you.

You may NOT, under any circumstances:

  • Resell, rent, lease, sublicense, distribute, or share the Product (in whole or in part), whether in its original form or modified;
  • Claim authorship or ownership of the Product or any portion of its content;
  • Edit, alter, rebrand, white-label, or create derivative works from the Product for the purpose of distribution, resale, or public sharing;
  • Upload, post, or share the Product on any third-party website, marketplace, sharing platform, forum, or social media in a way that makes it accessible to others beyond your own use;
  • Use the Product, or any excerpt of it, in advertising, marketing materials, or any commercial promotion without our prior written consent.

2. Intellectual Property

The Product and its original content, features, and functionality are owned by My Visionz LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. All rights not expressly granted to you under Section 1 are reserved by My Visionz LLC.

3. Third-Party Commercial or Advertising Use

Any use of the Product, or any portion of its content, by a third party for advertising, marketing, promotional, or other commercial purposes requires a separate written licensing agreement with My Visionz LLC and payment of applicable licensing fees, negotiated in advance. Unauthorized commercial use of the Product may result in legal action.

4. User Content

Separately from the Product itself, you may be able to submit, post, or upload your own content to us — for example, a testimonial, review, or message ("User Content"). By doing so, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any form, media, or technology. This section governs only content you choose to submit to us — it does not affect your ownership of anything you create independently.

5. Payment

You agree to pay all fees or charges incurred through your use of the Product, as well as any applicable taxes. Payments will be processed through our secure payment gateway.

6. Refunds

All digital product sales are final. Due to the instant-access, downloadable nature of our products, we do not offer refunds once a purchase is complete. If you experience a technical issue with your purchase, such as a broken or inaccessible download link, please contact us at hello@myvisionz.com and we will work to resolve it.

7. Limitation of Liability

In no event shall My Visionz LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Product; (ii) any conduct or content of any third party on the Product; (iii) any content obtained from the Product; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Indemnification

You agree to indemnify and hold harmless My Visionz LLC and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of the Product or any violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
